Terms of Service

These terms govern your use of the POS Pakistan software, hardware, and services (together, the "Services"). By subscribing to or using the Services, the business named in your order ("you") agrees to these terms. Contact us at sales@pospakistan.com with any questions.
1. The Services
POS Pakistan provides point-of-sale software (restaurant, retail, invoicing, ERP, KDS, drive-thru, self-service kiosk), POS hardware, and related support, as described on the order form or quote accepted by you. Software is provided as a subscription service unless your order states otherwise. Hardware is provided as a one-time purchase with the warranty described below.
2. Accounts and responsibilities
- You must keep your login credentials secure and control who in your business has access.
- You are responsible for the accuracy of the data entered into the Services.
- You are responsible for your own tax registrations (NTN, sales tax, provincial) and for the tax configuration applied to your account. The Services help you comply, but you remain responsible for your legal filings.
- You agree not to resell the Services, sublicense them, or use them for anyone other than your own business, without our written consent.
3. Fees and billing
Subscriptions
Subscription fees are payable in advance for the billing period stated in your order (monthly or annual), in Pakistani Rupees unless stated otherwise. Fees are based on the branch count and modules in your order; adding branches or modules increases the fee from the next billing period.
Hardware
Hardware is invoiced at the price on your quote, plus applicable tax. Payment is due before delivery unless credit terms are agreed in writing. Delivery timelines are estimates, not guarantees.
Late and missed payments
If a payment is not received by its due date, we may suspend access to software features or services until payment is made. Suspension does not cancel your obligation to pay. We will notify you before any suspension where reasonably possible.
4. Your data
All sales, inventory, and business data you enter into the Services belongs to you. We process it to operate the Services and to comply with law, including FBR digital invoicing and provincial sales tax transmission. We do not claim ownership of your data. On termination of your subscription, you may export your data during the subscription period; after termination we retain data only as required by law.
5. Hardware warranty and returns
Hardware carries the warranty stated on your invoice. Software updates and FBR compliance updates are included while your subscription is active. Return rights and the refund process are set out in our separate Refund Policy.
6. Service availability
We work to keep the Services available and reliable, including offline operation of tills during connectivity loss. You accept that no service is fault-free: scheduled maintenance, network issues, and third-party outages (power, internet, payment providers, FBR systems) can interrupt service, and we are not liable for consequential losses arising from such interruptions. We will use reasonable efforts to inform you of planned maintenance.
7. Acceptable use
- Use the Services only for lawful business purposes and in compliance with Pakistan law.
- Do not use the Services to process fraudulent, illegal, or prohibited transactions.
- Do not attempt to reverse engineer, break, or interfere with the Services or other customers' data.
- Do not misrepresent your business, tax status, or item data in ways that create false records.
8. Intellectual property
The software, documentation, and branding remain our property (or our licensors'). Your order grants you a limited, non-exclusive right to use the software for your business during your subscription. You may not copy, distribute, or create derivative works from the software.
9. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim relating to the Services is limited to the fees you paid in the twelve months before the claim. We are not liable for indirect, incidental, or consequential losses, including lost revenue or profits, data loss, or business interruption, even if advised of the possibility. Nothing in these terms limits liability that cannot be limited by law.
10. Termination
Either party may terminate the subscription at the end of a billing period with notice as described in your order. We may terminate immediately for material breach, fraud, or failure to pay. On termination, your access ends at the end of the paid period, and you may export your data as described above.
11. Changes and governing law
We may update these terms with notice by email or in-product notification; continued use after the effective date constitutes acceptance. These terms are governed by the laws of Pakistan, and disputes are subject to the jurisdiction of the courts of Karachi.
